Welcome to Canine’s Halo. By using our website, drone search operations, or any related communications and services, you agree to comply with and be bound by these Terms of Use (“Terms”). Please read them carefully. If you do not agree, do not use our services.

1. Service Overview

Canine’s Halo provides aerial and ground-based drone search services primarily focused on locating lost pets using thermal imaging and other advanced technologies. Depending on location and circumstances, searches may be offered as either paid or complimentary.

Scope of Services:

Canine’s Halo provides thermal drone search services solely intended to assist in locating lost pets. We do not provide investigative services of any kind. Our operators are not licensed private investigators and do not perform surveillance, stakeouts, or any activities intended to identify or apprehend individuals.

Our services are strictly limited to search and recovery support for missing pets. We cannot track, locate, or investigate stolen animals, nor can we engage in law enforcement or criminal investigation activities. In cases involving theft or suspected criminal acts, clients are encouraged to contact their local law enforcement authorities.

2. Eligibility for Use

By engaging with Canine’s Halo, you represent that:

• You are at least 18 years of age, or have parental or guardian consent.
• You are legally permitted to enter into binding contracts.
• You will provide accurate, complete, and current information during the service request process.

3. User Responsibilities

You agree to:

• Provide complete and accurate details about your lost pet, including photos, behavioral information, last known location, and any relevant medical conditions.
• Be available for communication during the search operation.
• Follow all safety instructions from Canine’s Halo personnel, including staying clear of restricted search areas unless specifically permitted.
• Ensure you have the legal authority to grant Canine’s Halo access to the search area.

4. Service Limitations and Disclaimers

• No Guarantee of Recovery: While Canine’s Halo uses advanced technology and experienced pilots, we cannot guarantee that any pet will be found. Numerous factors, including terrain, weather, animal behavior, and time elapsed, may affect results.
• Regulatory Compliance: All operations are conducted in accordance with federal, state, and local regulations, including FAA rules. We may be unable to operate in restricted zones or adverse conditions.
• Service Availability: Service availability depends on location, operational capacity, and safety conditions. We do not guarantee availability in all areas or at all times.
• Service Fees: Some search missions are complimentary, while others incur fees, which will be clearly communicated in advance of any operation.

5. Operational Authority

All flight operations, procedures, and methods are conducted under the sole authority of Canine’s Halo and its licensed operators.

While we value and consider client input regarding search areas, points of interest, or potential sightings, the final determination of flight paths, operational methods, and safety procedures rests exclusively with Canine’s Halo.

Clients may not direct, override, or interfere with any operational decision during an active mission. Canine’s Halo reserves the right to modify, suspend, or terminate a search operation at any time if safety, legal, or environmental concerns arise.

6. Cancellation and Rescheduling

Cancellation Before Service Begins:

You may cancel or reschedule a scheduled search by providing written notice to Canine’s Halo. Unless a specific policy is outlined on your invoice or Service Agreement, the following standard cancellation policy applies:

Local Service Area (<150 Miles from Austin, TX)

Regional or Extended Service Area (150–400 Miles)

For services outside the Local Service Area, refunds are granted at the sole discretion of Canine’s Halo, unless otherwise stated on the applicable invoice or service agreement.

Cancellation After Service Begins:

Fees are non-refundable once the search service (including travel to the location) has begun.

Canine’s Halo Cancellations

Canine’s Halo reserves the right to cancel or reschedule any operation due to weather conditions, airspace restrictions, safety concerns, equipment malfunction, or other unforeseen circumstances. In such cases, any prepaid fees will either be refunded in full or credited toward a rescheduled service, according to the client’s preference.

7. Assumption of Risk and Safety Acknowledgment

By engaging Canine’s Halo’s services, you acknowledge that drone operations may involve certain risks, including aerial flight over varying terrain and environmental hazards. You expressly assume all risks associated with your own recovery efforts, including traversing hazardous terrain or encountering dangerous wildlife.

You agree to comply with all safety instructions provided by Canine’s Halo and to remain outside designated flight or recovery areas unless expressly permitted. Canine’s Halo shall not be liable for any injury or property damage resulting from client non-compliance with safety directions.

8. Responsibility for Equipment

In the event Canine’s Halo leaves or loans equipment (such as humane traps, wildlife cameras, or trap alarms) to you, a refundable Security Deposit will be collected prior to deployment. The initial six (6) calendar days of the loan period are provided as a grace period and are free of charge.

A usage fee of $35.00 per week, per piece of equipment, will be deducted from the Security Deposit commencing on the 7th day of deployment, and subsequently every 7 days thereafter. Each deduction is paid in advance and covers the subsequent 7-day period (or any portion thereof).

All equipment must be returned to Canine’s Halo within 4 weeks of deployment. If equipment is not returned within 4 weeks, you forfeit the remaining balance of the Security Deposit. A final invoice will be generated for the total deposit amount to satisfy the forfeiture.

You assume full responsibility for the equipment and agree not to move, tamper with, or modify it. If equipment is lost, stolen, or damaged beyond the value of the deposit, you agree to pay the remaining full replacement cost.

9. Liability and Warranty Disclaimer

• No Warranty: Services are provided “as is” and “as available.” Canine’s Halo makes no express or implied warranties regarding accuracy, effectiveness, or fitness for a particular purpose.
• Limitation of Liability: In no event shall Canine’s Halo, its employees, or contractors be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our services, including emotional distress or financial loss.
• Force Majeure: Canine’s Halo is not liable for any delay or failure caused by circumstances beyond our control, including natural disasters, war, government restrictions, or technical failures.

10. Audio/Video Recording & Media Release

• Operational Recording: You acknowledge and consent that flight operations are recorded for safety, liability, compliance, training, promotional, and quality assurance purposes. This includes high-definition video from the aircraft and continuous audio recording of all communications and conversations occurring in the vicinity of the pilot and ground control station.
• Media License: By using Canine’s Halo’s services, you grant Canine’s Halo a non-exclusive, royalty-free, perpetual license to use any images, videos, or audio recordings captured during the search for educational, promotional, or operational purposes, provided that personally identifying information is not disclosed without your consent.

11. Payment Terms

• Fees: All payments for services rendered are due as stated on the applicable invoice. You acknowledge that payment is for the search effort, flight time, and expertise provided, regardless of the search outcome.
• Holiday Surcharges: Services provided during recognized U.S. National Holidays are subject to an additional surcharge. To support operational availability, this surcharge applies to the holiday itself, the two days immediately preceding, and the two days immediately following the holiday. The specific surcharge amount will be quoted prior to the deployment of assets.
• Administrative Fees: If an authorized payment fails, is declined, or is returned for any reason, a $100.00 administrative fee will be added to the service charge to cover reprocessing costs.
• Disputes: Unauthorized chargebacks or payment disputes will constitute a breach of these Terms. Canine’s Halo reserves the right to recover all associated collection costs, including reasonable attorney’s fees, court costs, and/or arbitration filing expenses.

12. User Conduct

You agree not to:

• Violate any applicable laws or regulations.
• Misrepresent or withhold information about your pet, its disappearance, or any search efforts previously or currently being undertaken.
• Use Canine’s Halo’s services for fraudulent, defamatory, or malicious purposes.

13. Intellectual Property

All content, including logos, website materials, drone footage, and related media, is the intellectual property of Canine’s Halo and protected under applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works without express written consent from Canine’s Halo.

14. Privacy

Your privacy matters to us. Please review our Privacy Policy for details on how we collect, use, and safeguard your personal information.

15. Third-Party Links

Our website or communications may include links to external websites or services. These are provided for convenience only. Canine’s Halo does not endorse and is not responsible for the content, privacy policies, or practices of any third-party sites.

16. Arbitration Agreement

Any dispute, claim, or controversy arising out of or in connection with your use of Canine’s Halo’s services, website, communications, or these Terms of Use shall be resolved exclusively through binding arbitration, rather than in court.

• Arbitration Forum: The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules (or Commercial Rules, as applicable), and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
• Location: Unless otherwise agreed by both parties, arbitration shall take place in Travis County, Texas.
• Arbitrator Authority: The arbitrator shall have exclusive authority to resolve all disputes regarding the interpretation, applicability, enforceability, or formation of this arbitration agreement.
• Class Action Waiver: You and Canine’s Halo agree that all claims will be brought on an individual basis, and not as part of any class, consolidated, or representative action.
• Small Claims Exception: Either party may seek relief in small claims court for disputes within its jurisdictional limits.
• Injunctive Relief: Nothing in this clause prevents Canine’s Halo from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction to protect its rights pending arbitration.

By using Canine’s Halo’s services, you acknowledge and agree that you are waiving the right to a jury trial and to participate in any class or representative action against Canine’s Halo.

17. Electronic Communications

You consent to receive communications from Canine’s Halo electronically, including email, SMS, and online forms. You agree that such communications satisfy any legal requirement that communications be in writing.

18. Modifications to Terms

Canine’s Halo reserves the right to modify these Terms of Use at any time. Updates will be posted on our website or communicated directly. Continued use of our services constitutes your acceptance of the revised Terms.

19. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the courts of Travis County, Texas, subject to the arbitration provisions herein.

20. Entire Agreement and Severability

These Terms of Use, along with any specific Service Agreement entered into, constitute the entire agreement between you and Canine’s Halo. If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

21. Indemnification

You agree to indemnify and hold harmless Canine’s Halo, its employees, contractors, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

1. Your breach of these Terms;
2. Your provision of inaccurate information;
3. Any recovery efforts undertaken by you or your agents.
